Using Another Person’s Firearm

In the South African context, using another’s firearm requires adherence to specific guidelines to ensure legal and safe use.

Firearms Control Act Section 22 of the Firearms Control Act 60 of 2000 states that a person who is at least 21 years old and has a firearm license can allow someone else to use their firearm under their direct supervision. This can only happen if it is safe and for a lawful purpose. Whilst the Firearms Control Act 60 of 2000 (FCA) does not go into the exact details of the ‘‘how’, the requirement is that the firearm remains under the licence holders direct supervision and this is quite clear.
