Speaker Thandi Modise applies for discharge in animal cruelty case

Modise was back in the dock yesterday at the Potchefstroom Regional Court. Modise is privately being prosecuted by AfriForum. The organisation’s chief investigator, Andrew Leask, said the private prosecution, led by the head of AfriForum’s private prosecution unit, advocate Gerrie Nel, closed its case yesterday. The defence then brought an application to have Modise discharged in terms of Section 174 of the Criminal Procedure Act. The act deals with the right of an accused to be discharged from the offence he or she has allegedly committed where, at the close of the State’s case, there is insufficient evidence.
